Terms of Service
All services provided by Hybrid-Host.net may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless of Hybrid Hosting from any claims resulting from the use of service which damages the subscriber or any other party.
Prohibited are sites that promote any illegal activity or present content that may be damaging to our servers, or any other server on the Internet. Links to such materials are also prohibited.
You hereby acknowledge that if we find unacceptable content on your hosted site, we have the right to cancel/suspend your account without notification. There will be no refunds and the legal authorities may be contacted if this rule is not abided by. Unacceptable material includes, but not limited to:
- Adult material
- Illegal activities
- Fraud
- Hacking discussion or programs
- Proxies
- Copyrighted material
- Warez or warez linking
- Obscene or threatening material
- Nulled scripts
- IRC or IRC bots
- Torrents, Torrent Trackers, Rapidleech or similar
- Audio or video streaming
- File, MP3 or image hosting
- Spam or mass emailing
Fair Usage
Please do not create accounts or upload files that you have no intention of using. Also, as part of our fair usage policy, excessive CPU draining is not allowed. Furthermore, you may not initiate the following on our servers:
- Run any type of internet relay chat applications that require server resources.
- Run stand-alone, unattended server-side processes at any point in time on the server.
- Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
- Run cron entries with intervals of less than 15 minutes.
- Run download or mirror sites
Other Limitations
- CPU usage may not exceed 20% per domain in 90 seconds
- Memory usage may not exceed 20% per domain in 90 seconds
- Outgoing emails may not exceed 50 per domain
- MySQL connections may not exceed 100
- Apache connections may not exceed 25
Unmetered Space and Bandwidth
Nothing in the world is unlimited, and that includes hard drive space and bandwidth. If you see unmetered space or bandwidth, it means we do not keep track of how much space you are using. Clients can use as much as they need, for web hosting purposes only. If you cause problems for our servers and abuse the services provided, we reserve the right to suspend or terminate your account without notice.
NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE. WE MAY ALSO NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.
Resellers
Reseller accounts must agree to the above user content rules. Faliure to do so may lead to account suspension.
You may run free hosting sites but please be careful when using automated account scripts as this often leads to abuse. It is your responsibility to make sure your clients are following our rules. We will intervene if problems occur on our servers. Please note that you should be providing tier-1 support for your clients.
Server Abuse
An attempt to undermine or cause harm to the server or a customer of Hybrid Hosting is strictly prohibited.
Billing
By the Account Activation Date of each year, Hybrid Hosting shall either: (1) debit the client's credit card (when such information has been provided by the client); or (2) deliver by e-mail an invoice in accordance with the applicable Service Fees for services rendered for the calendar year. When an invoice is delivered to the client, payment shall be remitted to Hybrid Hosting by no later than the specified payment due date. Hybrid Hosting shall be entitled to immediately terminate this agreement for client's failure to make timely payments. You will be provided with an invoice on a yearly basis, on the day the plan was purchased. It is the client's responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with another credit card account number within 72 hours. If we do not receive a response within 72 hours, the account, and all accounts under that account plan, will be suspended.
Free Domains and Registration
Any domains that you have registered by us are property of Hybrid Hosting. All domains are registered under NameCheap.com or otherwise stated by us. We manage your domains and perform any necessary requests that a customer may have. There are no refunds for domains. Domains will be renewed when appropriate. If you decide to part ways with us, we can transfer the domain to your registrar.
Account Cancellations
Accounts are subject to being removed or suspended if it is left inactive for more than 6 months. If you would like to cancel your account for whatever reason, please contact us and we will do so according to your request.
Refunds
Hybrid-Host.net provides 100% of payment if (1) client is within the 30 day money back Guarantee period, and (2) client did not breach any of Hybrid Hosting's terms of service. We reserve the right to withhold a refund for any reason.
Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.
Limitation of Liability
We shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from our server going off-line or being unavailable for any reason whatsoever. Furthermore, Hybrid Hosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from our server. All damages shall be limited to the immediate termination of service.
Violations
Violations of these Acceptable Use Policies should be referred to service@hybrid-host.net. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.
Disclaimer
Hybrid Hosting cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by us are resold. Thus, certain equipment, routing, software and programming used by us are not directly owned or written by Hybrid Hosting. Moreover, Hybrid Hosting holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as we see fit.
Account Activation
By activating your account with Hybrid Hosting, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.
NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail prior to taking any action to provide you with an opportunity to correct the problem.
Hybrid Hosting reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
